Document preparation for deeds
    • Valid identity card, driver's license, or passport;

    • Tax Code [Codice Fiscale] or National Health Service card;

    • Summary extract of the marriage certificate (on pia in paper) issued by the Municipality in which the marriage was entered into;

    • Deed of property of assets purchased after the marriage;

    • Non-EU: nationals: residence permit or long term residence card. 

  • Declaration of Succession

    Required documents:

    For deceased subjects:

    • Valid identity card, driver's license issued by the Prefect’s Office, or passport;

    • Tax Code [Codice Fiscale] or National Health Service card;

    • Death certificate;

    • Certificate of registered residence;

    • Historical extract of the family status register.

    For unmarried individuals: a single status/widowhood certificate (on plain paper).

    For married individuals (even if separated or in a marital community property regime): a summary extract of the marriage certificate (on plain paper).

    For separated/divorced individuals: a copy of the judicial separation decree or final divorce judgement

    For heirs

    • Valid identity card, driving license or passport;

    • Tax Code [Codce Fiscale] or National health Service                    Card;

    • Family status certificate;

    • Current Declaration in lieu of a notarial deed;

    • Renunciation of inheritance by the heirs, if applicable. For testamentary successions

    • Minutes of deposit and publication of holographic will;

    • Minutes of the transfer to the register of inter vivos                   deeds and registration of the public will;

    •  Documents for individual businesses and                                      shareholdings;

    •  Chamber of Commerce certificate;

    •  Deed of incorporation or deed of purchase;

    •  Financial situation at the date of death (net of                               goodwill);

    •  Current Acts of Association or latest notarial deed                      containing the updated corporate bylaws.

    For stocks, bonds, or other securities: relevant certifications.

    For real estate

    • Deed of acquisition (notarial deed, court judgment, or              declaration of succession);

    • Declaration of succession if it concerns land;

    • Certificate of Urban Planning Designation.                              For boat and aircraft documents: certificate of ownership.  For credit related documents

    • Grounds of entitlement and sum due;

    • Copy of the official recognition of the claim if the credit            is towards the State

    • For documents on banking relations

    • Bank certification of the accounts held by the                              deceased at the date of death, showing the balance of            the bank account

    • Securities on deposit;

    • Any liabilities (mortgages, current account overdrafts,              etc.)

    For documents related to liabilities

    Any invoices and/or documentation for funeral/medical expenses and other liabilities.

  •  

    Identity card of the legal representative; Tax Code [Codice Fiscale] and VAT number; Deed of Incorporations; Chamber of Commerce Registration Certificate (Company Register); current Articles of Association or latest notarial deed including the updated corporate bylaws.

    Furthermore, for entities managed by a Board of Directors, the minutes book will be required to produce an extract of the resolution authorizing the transaction.

    In the event of a conflict of interest involving the management body: resolution of the shareholders' meeting; real estate/land-related documents.

    For sellers: copy of the purchase notarial deed, with land registry transcription note.

  • Declaration of succession; death certificate; copy of the will publication minutes (if applicable)

    If the property is part of a condominium, the following documents will also be required:

    • Statement issued by the building manager;

    • Property layout plan issued by the land registry office              (catasto);

    • All relevant building/planning permits relating to the                property intended for sale;

    • A copy of the certificate of occupancy/habitability;

    • Energy Performance Certificate issued by an                                authorised certifier;

    • Certificate of compliance of the utility systems.

    If the relevant certificates are not available, the parties must agree upon and expressly declare their respective responsibilities and obligations in the deed.

    Where the seller is a construction company, the statutory ten-year insurance policy must be produced, where required by law.
